Kapittul 1

Gildisøki og allýsingar

Gildisøki

§ 1. Sambært § 2 í løgtingslógini er kunngerðin galdandi:

1)   í føroyskum umveldi og umborð á skipum undir føroyskum flaggi,

2)   fyri persónar, búsitandi í Føroyum, og

3)   fyri fyritøkur, skrásettar í Føroyum, ella sum verða riknar heilt ella lutvíst úr Føroyum.

Allýsingar

§ 2. Í hesi kunngerð er at skilja við:

1)   Sáttmáli ella transaktión: Einhvør transaktión, sama hvat slag og uttan mun til hvør lóggáva er galdandi, samansett av einum ella fleiri sáttmálum ella samsvarandi bindingum, sum eru gjørdar millum somu ella ymsar partar.

2)   Evropeiska búskaparøkið: Limaland í Evropa samveldinum, Noreg, Ísland og Liktinstein.

3)   Ognarlutir: Øll sløg av ognum, materiellar ella immateriellar, fastogn ella leysafæ, sum ikki er peningur, men sum kann nýtast til at fáa til vegar pening, vørur ella tænastur.

4)   Frysting av ognarlutum: At forða fyri, at ognarlutir á nakran hátt verða nýttir at fáa til vegar pening, vørur ella tænastur, íroknað, men ikki avmarkað, til at selja, útleiga ella veðseta hesar.

5)   Meklaratænastur:

a)    samráðing ella skipan av flytingum við tí endamáli at keypa, selja ella veita vørur og tøkni, ella fíggjarligar og tøkniligar tænastur, heruppií frá einum triðjalandi til annað triðjaland, ella

b)    søla ella keyp av vørum og tøkni ella tøkniligum tænastum, heruppií tá hesar eru staddar í triðjalondum við tí endamáli at verða fluttar til annað triðjaland.

6)   Tøkniligur stuðul: Einhvør tøkniligur stuðul í sambandi við umvæling, menning, framleiðslu, montering, kanning, viðlíkahald ella øll sløg av tøkniligum tænastum, sama um stuðulin verður veittur sum vegleiðing, ráðgeving, upplæring, flyting av rakstrarkunnleika ella førleikum ella ráðgevaratænastur; tøknilig hjálp fevnir eisini um munnliga hjálp.

7)   Krav: Eitthvørt krav, sum semja ella ósemja er um, sambært ella í tilknýti til ein sáttmála ella transaktión, serliga:

a)    krav um fulnað fyri skyldu sambært ella í tilknýti til ein sáttmála ella eina transaktión,

b)    krav um endurgjald viðvíkjandi sáttmála ella transaktión,

c)    mótkrav, ella

d)   krav um viðurkenning ella fullgerð, eisini við eksigibiliteti, av dómi, gerðarrættarúrskurði ella samsvarandi avgerð, sama hvar úrskurðurin ella dómurin eru sagdir, ella avgerðin er tikin.

8)   Íløgutænastur: Fylgjandi tænastur og virksemi:

a)    at taka ímóti og flyta bíleggingar, sum eru knýttar at einum ella fleiri fíggjarligum amboðum,

b)    avgreiðsla av bíleggingum vegna kundar,

c)    handil fyri egna rokning,

d)   umsiting av virðisbrævaognum, og

e)    íløguráðgeving.

9)   Fígging ella fíggjarligur stuðul: Einhvør gerð, uttan mun til hvør leistur verður nýttur, sum merkir, at viðkomandi persónur ella eind, við ella uttan fyrivarni, rindar út ella bindur seg til at rinda út egnan pening ella búskaparligt tilfeingi, heruppií, men ikki avmarkað til, ískoyti, lán, trygd, veðhald, skuldarbrøv, remburs, veitingarkreditt, keypikreditt, innflutningsforskot ella útflutningsforskot og øll sløg av trygging og endurtrygging, heruppií útflutningskreditttrygging. Gjald og treytir fyri gjaldi av prísinum, sum semja er um fyri eina vøru ella tænastu samsvarandi vanligari handilssiðvenju, er ikki fígging ella fíggjarligur stuðul.

10) Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia: Ikki stjórnarstýrdu økini í fylkjunum Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia.

11) Eind í Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia: Eitthvørt felag, sum er skrásett sum heimahoyrandi í ella hevur sína høvuðsumsiting ella sítt høvuðssæti í Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia, sum hevur dótturfeløg ella atknýtt virksemi undir sínum ræði í Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia, ella sum hevur deildir ella aðrar eindir, sum reka virksemi í Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia.

12) Vørur við uppruna í Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia: Vørur, sum í síni heild eru framleiddar í Donetsk, Kherson, Krim, Luhansk og Zaporizhzhiaella um týðandi partur av seinastu viðgerðini hevur verið har.

13) Triðjaland: Eitt land, sum ikki er Føroyar ella eitt limaland í Evropasamveldinum, eftir hetta nevnt ES.

14) Fiskiskip: Skip ella far, sum er gjørt út til, ella verður nýtt til vinnuligan fiskiskap.

15) Stuttleikaskip: Skip ella far, sum ikki verður nýtt til vinnuligt endamál, har skrokklongdin er millum 2,5 og 24 metrar.

16) Persónligt far: Far, sum er ætlað til ítróttarendamál ella frítíðarvirksemi, har skrokklongdin er undir 4 metrar.

Kapittul 2

Fíggjarligar avmarkingar o.a.

Frysting av ognum

§ 3. Allir ognarlutir, sum eru ogn, í varðveitslu ella undir ræði hjá likamligum ella løgfrøðiligum persónum, nevndir í skjali 1, skulu frystast.

Stk. 2. Eingin ognarlutur skal vera til fyrimuns fyri ella latast likamligum ella løgfrøðiligum persónum, nevndir í skjali 1, at ráða yvir, hvørki beinleiðis ella óbeinleiðis.

3 a. 1) Allir ognarlutir, sum eru ogn, í varðveitslu ella undir ræði hjá likamligum ella løgfrøðiligum persónum ella eindum, nevndir í skjali 1 A ella 1 B, skulu frystast.

Stk. 2. Eingin ognarlutur skal vera til fyrimuns fyri ella latast likamligum ella løgfrøðiligum persónum ella eindum, nevndir í skjali 1 A ella 1 B, at ráða yvir, hvørki beinleiðis ella óbeinleiðis.

Stk. 3. Stk. 1 og 2 eru ikki galdandi fyri fiskiskap í altjóða sjógvi, sum er heimilaður í fiskiveiðuavtaluni millum Føroyar og Russland. Undantakið er ikki galdandi fyri føroyskar likamligar ella løgfrøðiligar persónar ella eindir.

Undantøk frá frysting av ognum

§ 4. Landsstýrisfólkið kann eftir umsókn geva undantak frá ásetingunum í § 3 og geva loyvi at leysgeva ella lata ávísar frystar ognarlutir at ráða yvir.

Forboð fyri transaktiónum til eindir, sum eru stovnsettar í Russlandi

§ 5. Tað er bannað beinleiðis ella óbeinleiðis at luttaka í transaktiónum til:

1)   løgfrøðiligar persónar, sum eru stovnsettir í Russlandi og undir almennum ræði, ella har tað almenna eigur omanfyri 50%, og har Russland, stjórn Russlands ella miðbanki Russlands hava rætt til vinningsbýti, ella har Russland, stjórn Russlands ella miðbanki Russlands hava onnur týðandi búskaparlig sambond, sum nevnd í skjali 4,

2)   løgfrøðiligar persónar, stovnsettir uttanfyri Føroyar ella ES, um ognarrættindi beinleiðis ella óbeinleiðis eru meira enn 50% hjá eini eind, nevnd í skjali 4, ella

3)   løgfrøðiligar persónar, sum virka vegna ella eftir boðum frá eini eind, nevnd í nr. 1 ella 2.

Stk. 2. Forboðið í stk. 1 er ikki galdandi fyri fulnað áðrenn 5. desember 2024 av sáttmálum, sum eru gjørdir áðrenn 5. november 2024 við løgfrøðiligar persónar nevndir í lista B í skjali 4 ella atknýttar sáttmálar, sum eru neyðugir fyri at fremja slíkar sáttmálar.

Stk. 3. Forboðið í stk. 1 er ikki galdandi fyri transaktiónir nevndar í grein 5aa stk. 2-4 í fyriskipan Ráðsins 833/2014, sambært skjal 16.

Forboð fyri íløgum og almennari fígging

§ 6. Tað er bannað at veita almenna fígging til virksemi í Russlandi.

Stk. 2. Forboðið í stk. 1 er ikki galdandi fyri veiting av almennari fígging ella fíggjarligum stuðli til handil við matvørum, og til landbúnaðarendamál ella hjálpartiltøk.

Stk. 3. Tað er bannað likamligum persónum, búsitandi í Føroyum, og løgfrøðiligum persónum stovnsettir í Føroyum, at gera íløgur í Russlandi.

Forboð fyri tillutan av almennum sáttmálum

§ 7. Tað er bannað at tilluta almennar sáttmálar ella loyvissáttmálar við:

1)   russiskar ríkisborgarar búsitandi í Russlandi ella løgfrøðiligar persónar stovnsettir í Russlandi,

2)   løgfrøðiligar persónar, um ognarrættindi beinleiðis ella óbeinleiðis eru meira enn 50% hjá eini eind, nevnd í nr. 1, ella

3)   løgfrøðiligar persónar, sum virka vegna ella eftir boðum frá eini eind nevnd í nr. 1 ella 2, heruppií undirveitarar og veitarar, um tey standa fyri meira enn 10% av sáttmálavirðinum.

Stk. 2. 1) Landsstýrisfólkið kann, hóast stk. 1, geva loyvi at tilluta og leingja sáttmálar, við atliti at rakstri av sendistovum Føroya ella hjá ES í Russlandi, undir hesum sendinevndir, sendistovur, ella av millumtjóða felagsskapum í Russlandi, sum hava óárin sambært altjóðarætti.

Forboð fyri skráseting o.a.

§ 8. Tað er bannað at skráseta ella útvega skrivstovu, virkisbústað ella skrivstovubústað, umframt umsitingartænastur, til ein trust ella líknandi løgfrøðiliga skipan, sum hevur umsitara ella ein njótunartilskilaðan, sum eru:

1)   russiskir ríkisborgarar ella likamligir persónar, búsitandi í Russlandi,

2)   løgfrøðiligir persónar, stovnsettir í Russlandi,

3)   løgfrøðiligir persónar, um ognarrættindi beinleiðis ella óbeinleiðis eru meira enn 50% hjá eini eind, nevnd í nr. 1 ella 2,

4)   løgfrøðiligir persónar, sum eru undir ræði hjá einum likamligum ella løgfrøðiligum persóni, nevndur í nr. 1, 2 ella 3, ella

5)   likamligir ella løgfrøðiligir persónar, sum virka vegna ella eftir boðum frá likamligum ella løgfrøðiligum persóni, nevndur í nr. 1-3 ella 4.

Stk. 2. Tað er bannað at virka sum ella syrgja fyri, at ein annar persónur virkar sum trustumsitari, nominellur partaeigari, stjóri, skrivari ella líknandi í einum trusti ella líknandi løgfrøðiligari skipan, sum nevnt í stk. 1.

Stk. 3. Ásetingarnar í stk. 1 og 2 eru ikki galdandi, um umsitarin ella tann njótunartilskilaði eru ríkisborgarar í einum ES-limalandi ella ein likamligur persónur við tíðaravmarkaðum ella varandi uppihaldsloyvi í Føroyum ella einum ES-limalandi.

Forboð fyri at veita ávísar tænastur

§ 9. Tað er bannað beinleiðis ella óbeinleiðis at veita tænastur viðvíkjandi roknskaparføring, grannskoðan, heruppií lógarkravdari grannskoðan, bókhaldi, skattaráðgeving, virkisráðgeving, leiðsluráðgeving og lýsingarráðgeving, at veita arkitektatænastur, verkfrøðingatænastur, løgfrøðiliga ráðgeving og ráðgevingartænastur viðvíkjandi kunningartøkni, umframt at veita marknaðarkanningar, meiningarkanningar, greiningartænastur og lýsingartænastur til:

1)   russisku stjórnina, ella

2)   løgfrøðiligar persónar ella eindir, sum eru stovnsett í Russlandi.

Stk. 2. Tað er bannað beinleiðis ella óbeinleiðis at selja veita, flyta, útflyta ella veita ritbúnað til leiðsluna í fyritøkum og ritbúnað til ídnaðarsniðgeving sambært skjali 15 til:

1)   russisku stjórnina, ella

2)   løgfrøðiligar persónar ella eindir, sum eru stovnsett í Russlandi.

Stk. 3. Forboðini í stk. 1 og 2 eru ikki galdandi fyri fulnað áðrenn 5. desember 2024 av sáttmálum, sum eru gjørdir áðrenn 5. november 2024.

Stk. 4. Forboðini í stk. 1 og 2 eru ikki galdandi fyri veitingar nevndar í grein 5n, stk. 5-8 í fyriskipan Ráðsins 833/2014.

Stk. 5. 1) Landsstýrisfólkið kann loyva veitingum nevndar í stk. 1 og 2 sambært treytunum í grein 5n, stk. 9-10 í fyriskipan Ráðsins 833/2014.

Kapittul 3

Avmarkingar fyri samstarv við Donetsk, Kherson, Krim, Luhansk og Zaporizhzhia

Forboð fyri innflutningi av vørum úr Donetsk, Kherson, Krim, Luhansk ella Zaporizhzhia

§ 10. Tað er bannað at innflyta vørur til Føroya, við uppruna í, og at keypa tænastur úr, Donetsk, Kherson, Krim, Luhansk ella Zaporizhzhia.

Forboð fyri ávísum íløgum í Donetsk, Kherson, Krim, Luhansk ella Zaporizhzhia

§ 11. Tað er bannað:

1)   at keypa ella víðka verandi ognarskap í fastogn í Donetsk, Kherson, Krim, Luhansk ella Zaporizhzhia,

Stk. 2. 2) Tað er bannað:

1)   Beinleiðis ella óbeinleiðis at keypa ella innflyta jarnvørur og stálvørur, sum nevndar í skjali 3, umframt vørur, sum nevndar eru í skjali 5, til Føroya, um hesar vørur:

a)    hava uppruna í Russlandi, ella

b)    eru útfluttar úr Russlandi.

2)   Beinleiðis ella óbeinleiðis at veita tøkniligan stuðul, meklaratænastur, fígging ella fíggjarligan stuðul, umframt trygging og endurtrygging, sum er galdandi fyri forboðini í nr. 1.

Stk. 3. 2) Forboðið sambært stk. 2, nr. 1, viðvíkjandi keypi ella innflutningi til Føroya av vørum undir CN 7601, umframt forboðið fyri at veita stuðul ella tænastur eftir § 2, stk. 2 í hesum sambandi, kemur í gildi 26. februar 2026.

Forboð fyri at leggja inn í havn

§ 15. Tað er bannað at loyva skipum, sum eru skrásett undir russiskum flaggi, at koma í havn í Føroyum.

Stk. 2. Forboðið í stk. 1 er eisini galdandi fyri skip, sum hevur skift russiskt flagg ella skráseting til annað flagg ella skráseting eftir 24. februar 2022.

Stk. 3. Í hesi áseting merkir eitt skip:

1)   skip ella far á 500 bruttotons ella meira, sum siglir í vinnuligari altjóða sigling,

§ 15 a. 2) Fyri skip, sum eru nevnd í skjali 6 A, er tað bannað beinleiðis ella óbeinleiðis at:

1)   geva nevndu skipum atgongd til havnir ella akkerspláss í føroyskum sjóumveldi, ella at nevndu skip fáa slíka atgongd,

2)   innflyta, keypa ella á annan hátt at flyta nevndu skip til Føroya,

3)   selja, útvega, leiga, heruppií at chartra, ella at útflyta nevndu skip,

4)   reka ella at manna nevndu skip,

5)   flaggskráseta nevndu skip,

6)   veita fígging ella fíggjarligan stuðul, heruppií trygging, umframt miðlanartænastur, heruppií skipsmekling, til nevndu skip,

7)   veita tekniskan stuðul ella aðrar tænastur, heruppií viðvíkjandi bunkring, útgerð, skifti av manning, lasting ella lossing, fendarahjálp ella sleipingartænastur til nevndu skip, og

8)   luttaka í skip-til-skip umskiping ella aðrari flyting av farmi, ella at keypa tænastur frá nevndu skipum.

Stk. 2. Skjal 6 A fevnir um skip, sum eru fevnd av artikli 3s, nr. 2, litra a-g, í fyriskipan Ráðsins nr. 833/2014, sum nærri tilskilað í fylgiskjali XLII til nevndu fyriskipan.

Stk. 3. Kapittul 5

Avmarkingar fyri víðari samhandil av ávísum vørum

§ 16. Um vørur sum nevndar eru í skjali 6 verða seldar, veittar, fluttar ella útfluttar til onnur lond enn limalondini í evropeiska búskaparøkinum, Sveis, Ný-Sæland, Kanada, Avstralia, Suður-Korea, Japan og Stórabretland, skal keyparin átaka sær ikki at útflyta vørurnar til Russland umframt at átaka sær ikki at útflyta vøruna til annað land við nýtslu í Russlandi fyri eyga.

Kapittul 6

Kapittul 7

Undantøk, uttanumvik, revsing og gildiskoma

Undantøk í serligum føri

§ 20. 1) Landsstýrisfólkið kann í serligum føri gera undantak frá kunngerðini, um reglurnar hava greiða ótilætlaða ávirkan og treytað av, at hetta ikki er ósambæriligt við endamálið við avmarkandi tiltøkunum.

That organisation received funding from Lobaye Invest, which has been associated with the Wagner Group. In 2022, Harouna Douamba established the Groupe Panafricain pour le Commerce et l'Investissement (GPCI) in Burkina Faso. GPCI has been involved in covert influence operations.

Harouna Douamba’s disinformation networks were dismantled by Meta in May 2021, and later in May 2023. Despite this, GPCI-related disinformation groups are still active and running structured and coordinated disinformation campaigns, with the use of a vast network of information chains. Those campaigns target France in particular, including through accusations of conspiracy, terrorism, destabilisation operations or preparing coups against the Union or its Member States.

RED has used its media platforms – often publishing under “redstreamnet” or “thered.stream” – to systematically spread false information on politically controversial subjects with the intent of creating ethnic, political and religious discord amongst its predominantly German target audience, including by disseminating the narratives of radical Islamic terrorist groups such as Hamas.

During a violent occupation of a German university by anti-Israel rioters, RED personnel coordinated with the occupiers to disseminate images of their vandalism – which included the use of Hamas symbols – through their online channels, thus providing them with an exclusive media platform, facilitating the violent nature of the protest.

Through his associates, including Artem Marchevskyi, Viktor Medvedchuk controlled Ukrainian media outlets and used them to disseminate pro-Russian propaganda in Ukraine and beyond. After the start of Russia’s war of aggression against Ukraine, Viktor Medvedchuk spread Russian propaganda narratives about the war, undermining Ukrainian sovereignty. To that end, in April 2023, Viktor Medvedchuk founded a political movement in Russia called “Another Ukraine”.

With his associates and associated entities, including Artem Marchevskyi and the Voice of Europe media channel, and in close coordination with the Russian authorities, Viktor Medvedchuk has continued funding and carrying out influence operations targeting political parties and individual politicians in Europe. Those activities aimed to support the foreign policy interests of the Russian Federation and to spread its influence, including ahead of the 2024 European Parliament elections. 2a.

The prohibition in paragraph 1 shall not apply to the reception of payments due by the legal persons, entities or bodies referred to in Part A of Annex XIX pursuant to contracts performed before 15 May 2022.

 

2c.

The prohibition in paragraph 1 shall not apply to the reception of payments due by the legal persons, entities or bodies referred to in Part B of Annex XIX pursuant to contracts performed before 8 January 2023.

 

2e.

The prohibition in paragraph 1 shall not apply to the reception of payments due by the legal persons, entities or bodies referred to in Part C of Annex XIX pursuant to contracts performed before 18 March 2023.

 

3.

(a)

transactions which are strictly necessary for the direct or indirect purchase, import or transport of natural gas, titanium, aluminium, copper, nickel, palladium and iron ore from or through Russia into the Union, a country member of the European Economic Area, Switzerland, or the Western Balkans;

 

(aa)

unless prohibited under Article 3m or 3n, transactions which are strictly necessary for the direct or indirect purchase, import or transport of oil, including refined petroleum products, from or through Russia;

 

(b)

transactions related to energy projects outside Russia in which a legal person, entity or body listed in Annex XIX is a minority shareholder;

 

(d)

transactions, including sales, which are strictly necessary for the wind-down, by 31 December 2024, of a joint venture or similar legal arrangement concluded before 16 March 2022, involving a legal person, entity or body referred to in paragraph 1;

 

(e)

transactions related to the provision of electronic communication services, data center services, and the provision of services and equipment necessary for their operation, maintenance, security, including the provision of firewalls, and call center services, to a legal person, entity or body listed in Annex XIX;

 

(f)

transactions which are necessary for the purchase, import or transport of pharmaceutical, medical, agricultural and food products, including wheat and fertilisers whose import, purchase and transport is allowed under this Regulation;

 

(g)

transactions which are strictly necessary to ensure access to judicial, administrative or arbitral proceedings in a Member State, as well as for the recognition or enforcement of a judgment or an arbitration award rendered in a Member State and if such transactions are consistent with the objectives of this Regulation and Regulation (EU) No 269/2014;

 

3a.

By way of derogation from paragraph 1, the competent authorities may authorise, under such conditions as they deem appropriate, transactions which are strictly necessary for the divestment and withdrawal by 31 December 2024, by the entities referred to in paragraph 1 or their subsidiaries in the Union from a legal person, entity or body established in the Union.

 

4.

By way of derogation from the procedure laid down in Article 7(3) of Regulation (EC) No 391/2009 of the European Parliament and of the Council and in Article 21(3) of Directive (EU) 2016/1629 of the European Parliament and of the Council, the Union's recognition of the Russian Maritime Register of Shipping under Regulation (EC) No 391/2009 and Directive (EU) 2016/1629 is withdrawn.
